The meeting was called to order by Chairman Hawley at 7:35 p.m. A quorum was present.

Chairman Dan Hawley; Boardmembers, Michael Borg, Mark Jaffray, Kenneth Vance; Alternate Ronna Freeland
 
ABSENT
 
Boardmembers Shirley Ford, Marco Palazzolo, Karen Worrell
 
ALSO PRESENT
 
 Randy Sapelak, Zoning Administrator
 
APPROVAL OF MINUTES
 
Regular Meeting August 5, 2010
 
ZB-10- 08 Borg moved, Jaffray seconded, to approve the minutes of the August 5, 2010 meeting as presented. Motion CARRIED
 
NEW BUSINESS
 
VA-10-04, Pollicella for 16-10-451-015, 131 S. Milford, #600, Forza Sports Bar, Req. Temporary Use Var. Sec. 94-422
 
Chairman Hawley acknowledged a letter received by the applicant, Denise Pollicella, dated 11/1/10 (on file at Village office), in which it states that she is no longer representing Forza Sports Bar & Grille.
 
Mr. Sapelak stated that he attempted to contacted the owner of the business, Michael Tomassi, but was only able to leave him a voice mail to inform him that if he intended to move forward with the proposed temporary use request to have a temporary bar and outside dining area beyond what was approved by Planning Commission in August for an outdoor seasonal café, he would need to be present at the meeting tonight.
 
Chairman Hawley suggested that all other items of business be handled first to allow the owner of Forza Sports Bar & Grille time to arrive.
 
There were no objections.
 
NEW BUSINESS
 
Election 2010 – 2011 Chairman & Vice-Chairman
 
ZB-10-09 Borg moved, Jaffray seconded, to nominate and elect Dan Hawley as ZBA Chairman for 2010 – 2011. Motion CARRIED
 
ZB-10-10 Vance moved, Jaffray seconded, to nominate and elect Michael Borg as ZBA Vice Chairman for 2010 – 2011. Motion CARRIED
 
CALL TO THE PUBLIC
 
There was no comment from the Public.
 
ADMINISTRATIVE COMMENTS
 
Mr. Sapelak reported that the YMCA had planned on coming before the ZBA to seek a variance to construct a pole barn in front of the existing building, but then decided to place the pole barn behind the building. They withdrew their request.
 
BOARDMEMBER COMMENTS
 
Boardmember Borg informed Mr. Sapelak that the illuminated sign is still in the window at the dental office located at 425 W. Huron. He reminded Mr. Sapelak that when Dr. Stevens was at the last ZBA meeting to request a variance to install a sign he said he would remove the illuminated sign from the window.
 
Mr. Sapelak said that he would visit the site and send a letter to Dr. Stevens if necessary.
 
Chairman Hawley welcomed new ZBA Alternate Ronna Freeland to the Board.

The Boardmembers briefly discussed the variance request and the fact that there was no representative at the meeting to state their intention to move forward with the request or their hardship for the request. They discussed that if they were to postpone the item until the next meeting, the date of the event for which the request is being sought would have passed.
 
Due to the fact there was no representative from Forza Sports Bar & Grille present for the meeting the Boardmembers agreed the request should be denied.
 
ZB-10-11 Borg moved, Jaffray seconded, to grant approval to VA-10-04, Pollicella for 16-10-451-015, 131 S. Milford, #600, Forza Sports Bar & Grille, for a temporary use variance from Sec. 94-422 (4). Motion FAILED
 
ADJOURN
 
The meeting was adjourned at 7:55 p.m.
