The meeting was called to order by Chairman Heidt at 7:30 p.m. A quorum was present.

APPROVAL OF MINUTES
 
Regular Meeting August 9, 2007
 
PC-07-66 Keef moved, Worrell seconded, to accept the minutes of the regular Planning Commission meeting of August 9, 2007, as amended:
Page 1-1, Motion PC-07-60 “…close the Public Hearing at 7:30…” change to “…close the Public Hearing at 7:39…”
Page 1-4, second paragraph, “…street but leaving the name “Top Value” at its current location”. change to “…street.”
Page 1-5, first paragraph, “…and asked…” change to “…and asked about the construction status and completion of the approved site plan.” Motion CARRIED
 
PUBLIC HEARING
 
SUP-07-01, Meloche, 16-10-430-005, 311 Mill, Request to Construct Day Care
 
PC-07-67 Zasuwa moved, Amerman seconded, to open the Public Hearing at 7:35 p.m. Motion CARRIED
 
Chairman Heidt read the Wade Trim review letter dated 8/22/07 (on file at Village office).
 
Michael Meloche was present to answer any questions from the Commissioners. He said they have gained the assistance of a land planner to help with the completion of the site plan. He said the size of the building has been reduced therefore reducing the number of children that can attend the day care.
 
Dorothy Madison, 431 W. Washington, was present and asked if they were intending to add a driveway onto Washington Street. She said she is “dead set” against a driveway on Washington Street, because of the amount of traffic already utilizing Washington Street.
 
Mr. Meloche said it has not yet been determined if an additional driveway would be necessary. He said however, that the day care has parents dropping off and picking up their children at different times of the day and that there would not be a steady flow of traffic at one particular time.
 
Commissioner Johnston asked how many children attend the day care currently. Mr. Meloche explained that 36 children are being served at the day care, but not necessarily at one time. He said the most attending the day care at one time is approximately 24.
 
Mr. Meloche said that he was not opposed to doing anything that would ensure the safety of the community. He explained that currently parents pull in and drop off their children. He said currently there is only room for five vehicles.
 
Commissioner Johnston stated for the record that he has an office located at 425 W. Huron which is adjacent to the day care.
 
Karen Reed, 514 General Motors Road, was present and said that she can see the day care from her house and stated that she wasn’t sure if there was a need for an additional driveway and suggested Mr. Meloche check with the day care to see if one was necessary. She said she walks in the morning and has not noticed large traffic flows going to or coming from the day care.
 
Edith Nader, 434 W. Huron, was present and asked if Mr. Meloche knew how many children the Fire Department says the day care is allowed to have.
 
Mr. Meloche said that the day care meets and will continue to meet state guidelines.
 
Commissioner Goodenow asked what the size of the building would be.
 
Mr. Meloche said the approximate size of the proposed building is 90’ x 32’. He said the intention is to construct the building in character with the adjoining residences.
 
Commissioner Goodenow referred to Sec. 94-388, (d) (i) a – h, review and approval of conditional uses, stating the criteria for approval. He said from the preliminary plan provided it would appear that the building looks like a type of “barracks” and is too plain.
 
Mr. Meloche said the current building is old and the structure has become obsolete. Commissioner Johnston said when the site plan is up for review he would like to see something very different from what was provided tonight.
 
Chairman Heidt stated that a letter from the owner allowing Mr. Meloche to act on their behalf and a certified survey of the parcel have not been provided. Chairman Heidt explained to Mr. Meloche that once he obtained the two items needed for recommendation of approval, another Public Hearing would need to be held and if Mr. Meloche is prepared, the site plan could be addressed at the same meeting.
 
Mr. Meloche asked that Planning Commission set another Public Hearing for the October meeting and he would plan on having the necessary information available for the special use approval as well as a completed site plan for review.
 
PC-07-68 Goodenow moved, Keef seconded, to close the Public Hearing at 8:09 p.m. Motion CARRIED
 
PC-07-69 Goodenow moved, Zasuwa seconded, to postpone action on SUP-07-01 for not more than 60 days and set a Public Hearing at such time.
 
DISCUSSION
 
Chairman Heidt said that if Mr. Meloche is intending to attend the October meeting, Planning Commission would need to set a Public Hearing tonight.

PC-07-70 Goodenow moved, Zasuwa seconded, to postpone action on SUP-07-01 for not more than 60 days. Motion CARRIED
 
PC-07-71 Amerman moved, Worrell seconded, to set a Public Hearing for SUP-07-01 for the October meeting. Motion CARRIED
 
UNFINISHED BUSINESS
 
SP-06-09, Carlson Homes, Inc., 16-11-155-005, 120 E. Liberty, Proposed 3-Story Office Building, Request for Postponement
 
PC-07-72 Zasuwa moved, Keef seconded, to postpone SP-06-09, Carlson Homes, Inc., 16-11-155-005, 120 E. Liberty Proposed 3-Story Office Building until the November meeting as requested by the applicant. Motion CARRIED
 
CALL TO THE PUBLIC
 
There was no response from the Public.
 
COMMISSIONER COMMENTS
 
Commissioner Goodenow asked if Chairman Heidt had gotten a report from administration on the status of Uptown Village at Milford.
 
Chairman Heidt said he had not and asked for a report for the October meeting.
 
Commissioner Goodenow reported that he attended the last Council meeting and explained to Council the Changeable Copy Sign ordinance amendment. He said Council did introduce the amendment as presented in the 2/15/07 Wade Trim letter (on file at Village office). He said he expected to see it adopted at the next Council meeting. He reported that the rezoning request for Sherwood Party Store was adopted by Council, but the amendment to Sec. 94-386, (h), Period of Completion was postponed. He said he would put together a letter of suggestions for the amendment for Wade Trim Consultant, Nick Lomako and Chairman Heidt to review.
 
Chairman Heidt asked that discussion of Sec. 94-386 (h), period of completion, be added to the October agenda.
 
Commissioner Goodenow said that he is going to get with DDA Director, Ann Barnette to come up with a language amendment for outdoor seating for the next season.
 
Commissioner Johnston asked what the object was, in front of Saint George’s Café on the weekends.
 
Chairman Heidt told him it was a bike rack.
 
Commissioner Johnston asked if Planning Commission had a role in decision making pertaining to street lights and roads.
 
Chairman Heidt explained that typically anything involving the right-of-way is determined or approved by Council. He said we can and do make recommendations to Council during the site plan process.
 
Commissioner Martin said that the bike rack in front of the Café has been used for the last few months and has been very popular and thinks it is a wonderful idea and good for the Village.
 
Commissioner Murad asked why the gate at Central Park has been left open to W. Liberty Street. He said the amount of traffic that has been using W. Liberty to by-pass downtown is significant.
 
Chairman Heidt asked administration to ask Village Manager, Arthur Shufflebarger about the gate at Central Park.
 
Commissioner Worrell asked that Planning Commission consider a revision to Sec. 94-354, fences and asked that it be on the October agenda for discussion.
