APPROVAL OF MINUTES
Regular Meeting October 14, 2010
PC-10-57 Amerman moved, Ebert seconded, to accept the minutes of the Regular Planning Commission meeting of October 14, 2010, as amended: Page 1-3, First sentence, “…the one review tonight.” Change to “…the one reviewed tonight.” Motion CARRIED
Special Meeting November 1, 2010
PC-10-58 Ebert moved, Juidici seconded, to accept the minutes of the Special Planning Commission meeting of November 1, 2010, as amended: Page 2-1, Last paragraph, “…along the eastern property…”, change to “…along the southern property…” Motion CARRIED

PUBLIC HEARING
Proposed Zoning Ordinance Text Amendment, Bicycle Rental/Display Racks, Sec. 94-189, (1) Item 3
PC-10-59 Amerman moved, Worrell seconded, to open the Public Hearing at 7:35 p.m. Motion CARRIED
Mr. Lomako reviewed his letter dated 8/23/10 (on file at Village office). There was no comment from the Public.
PC-10-60 Goodenow moved, Worrell seconded, to close the Public Hearing at 7:37 p.m. Motion CARRIED
PC-10-61 Goodenow moved, Juidici seconded, to recommend to Council the Proposed Zoning Ordinance Text Amendment to Sec. 94-189 (1), permitting bicycle rental/display racks in the Special Downtown District Overlay Zone as written in the Wade Trim letter dated 8/23/10. Motion CARRIED
Proposed Zoning Text Amendment, Sec. 94-342, Special Parking District, To Extend To Parcels, 16-11-105-012, 215 E. Commerce; 16-11-105-013, 219 E. Commerce; and 16-11-106-006, Vacant Property
PC-10-62 Amerman moved, Ebert seconded, to open the Pubic Hearing at 7:42 p.m. Motion CARRIED
Chairman Heidt reviewed with the Commissioners the reason for the request of extending the special parking district to the three parcels, stating that DDA Director, Ann Barnette, who was unable to attend the meeting tonight, initiated the request at the last meeting on behalf of Kim & Dan Russo, who are opening The Gathering Place located at 219 E. Commerce.
Extending the special parking district would allow for a reduction of the number of on-street parking spaces required for the type of use proposed, a banquet facility.
There was no comment from the Public.
PC-10-63 Amerman moved, Goodenow seconded, to close the Public Hearing at 7:44 p.m. Motion CARRIED
Commissioner Goodenow verified that there are no parcels on the south side of E. Commerce that are proposed to be in the Special Parking District.
Chairman Heidt stated that only the three parcels on the north side of E. Commerce were advertised to be included in the Special Parking District.
Mr. Lomako stated by extending the Special Parking District to the three parcels is acknowledging that some of the same circumstances of parking exist that other downtown properties have. He explained the ordinance applies a discounted value on parking and loading operations for parcels in the special parking district and they receive credit in the calculation of parking.
Commissioner Goodenow questioned whether or not the three parcels should also be included in the Special Downtown District Overlay Zone.
Mr. Lomako said he did not believe it necessary because the Russo’s did not express an interest in expanding the building.
Chairman Heidt said he would not be in favor of extending the Special Downtown District Overlay Zone without first having input from the DDA.
Mr. Lomako said as far as he could remember the Special Downtown District Overlay Zone and the Special Parking District have never matched.
PC-10-64 Amerman moved, Ebert seconded, to recommend to Council approval of the Proposed Zoning Text Amendment to Sec. 94-342, Special Parking District to extend to parcels 16-11-105-012, 215 E. Commerce; 16-11-105-013, 219 E. Commerce; and 16-11-106-006, vacant property.
DISCUSSION
Commissioner Goodenow said it would be a good idea to have a Commissioner attend the Council meeting should there be any questions about the recommendation.
Commissioner Juidici is scheduled to attend Council meetings in the month of December and said he would attend.
Commissioner Worrell suggested that a map indicating the exact location of the parcels to be included in the Special Parking District be included in Council’s packet.

UNFINISHED BUSINESS
Proposed Zoning Ordinance Text Amendment, Definitions, “Dance Studio”, Sec. 94-2, Home Occupation and Home-Based Businesses Regulations, Sec. 94-345
Mr. Lomako reviewed his letter dated 10/27/10, (on file at Village office).
The Commissioners, Mr. Sapelak and Mr. Lomako discussed the proposed changes.
PC-10-66 Amerman moved, Juidici seconded, to set a Public Hearing for the January 13, 2011, meeting for the proposed zoning ordinance text amendment to Sec. 94-2, Definitions and Sec. 94-345, Home Occupation and Home-Based Businesses Regulations. Motion CARRIED
CONSULTANTS COMMENTS
Mr. Lomako reported that he attended the last Council meeting and the moratorium on medical marijuana was extended for an additional six months. Since there are more areas within the Village where medical marijuana would be prohibited he suggested creating a map of those areas first to then determine where it would be permitted. He also reported that he sent Village Manger, Arthur Shufflebarger, a letter regarding new legislation that was passed recently pertaining to “Complete Streets”. Wade Trim has offered their services to help prepare and adopt a “complete streets” policy.
ADMINISTRATIVE COMMENTS
Mr. Sapelak reported that the YMCA did not move forward with their variance request to construct a pole building in the front yard of the property, but instead decided to construct the building behind the main facility. Forza Sports Bar who had applied for a variance to have a temporary bar and outside dining area beyond what was approved by Planning Commission in August did not show up at the Zoning Board of Appeals meeting so the request was denied.
COMMISSIONER COMMENTS
Commissioner Goodenow stated he would like the ordinance amendments to have the approved date listed on each page so that he could easily identify the most current language.
Commissioner Worrell reported that she attended the planning conference that was held downtown this year.
Commissioner Serchak said he would be attending a conference in Lansing where they would be discussing complete streets. He said he would gather information and return it to Planning Commission.
