APPROVAL OF MINUTES
Regular Meeting May 14, 2009
PC-09-31 Keef moved, Zasuwa seconded, to accept the minutes of the Regular Planning Commission meeting of May 14, 2009, as presented. Motion CARRIED

UNFINISHED BUSINESS
Recreational Vehicle Storage, Sec. 94-344 (b)
Mr. Lomako reviewed the current draft of the language amendment dated 5/24/09 (on file at Village office). He explained that at the May meeting it was requested by Planning Commission that he include illustrations of how the amendment would impact each of the residential zoning districts.
Commissioner Goodenow said that under “special provisions” of item (6) (c), he would prefer to actually state the requirement instead of just referencing Sec. 94-388, (3).
Commissioner Worrell said that she had driven through the Village and has collected pictures of homes that would be in violation of the proposed amendment, particularly in the R-4 Residential District. She also said that along with motor homes, all items being stored should be considered in the ordinance amendment.
Mr. Lomako said that a resident could apply for relief from the Zoning Board of Appeals if they could show a practical difficulty.
PC-09-32 Keef moved, Goodenow seconded, to set a Public Hearing for the proposed language amendment to Sec. 94-344 (b), Recreational Vehicle Storage, based upon the current draft dated 5/26/09, and changes discussed tonight regarding special provisions for the July 9, 2009 meeting. Motion CARRIED
Proposed Zoning Ordinance Text Amendments Resulting from PA 110 of 2006, Installment 3: Completion of Nonconforming Uses, Zoning as Controlling Ordinance and Prohibition Against Non-Contiguous Open Space
Mr. Lomako reviewed the three proposed amendments to the zoning ordinance necessary as a result of PA 110 of 2006 which were included in his letter dated 3/23/09 (on file at Village office). Mr. Lomako said he would provide a fourth installment to be reviewed at the July meeting and then as previously discussed all four installments can be presented to Council before setting a Public Hearing.
DISCUSSION
219 E. Commerce, Reuse Analysis
Subhash and Allison Kapur, owners of 219 E. Commerce, were present to inform the Commissioners of their intentions of developing the site into a jazz club where professional and amateur musicians can perform. Mr. Kapur provided a conceptual drawing of the building. He told the Commissioners that seating would consist of three levels including two box seat sections with a total seating capacity for approximately 150. He stated that he also owns the house located at 521 Hickory which is directly behind 219 E. Commerce and is hoping to use the house as a place for visiting musicians and their families to stay while performing.
Mr. Lomako reviewed his letter dated 6/4/09 (on file at Village office). He explained that the challenge for the proposed club is how to allow this type of use in the O-1 District and how to address the issue of parking. Also, he informed Mr. Kapur that he would need to contact the liquor control commission to see if any limitations exist with having a facility with a liquor license in close proximity to a nursery school. It was suggested that Mr. Kapur contact a traffic consultant, the liquor control commission, and his architect. Mr. Lomako said he would work on a language amendment that would allow the proposed type of use in the O-1 District as a Special Conditional Use.
ADMINISTRATIVE COMMENTS
Mr. Sapelak reported that he had sent letters to each of the owners of 140 E. Summit, but has received no response. He said his letter was to inform them that the property which had been rezoned as a Planned Unit Development would need to have the zoning changed before future developments could take place, explaining that once the Singh Development project fell through, the property did not revert to its prior zoning. He informed the Commissioners that the Poplars owned two of the parcels and Singh Development still owned one.
COMMISSIONER COMMENTS
Commissioner Goodenow commented that he read in the Milford Times that the Township Parks and Recreation were going to have a movie at the Farmer Jack parking lot in June.
Mr. Sapelak told him there was a misprint in the paper. Commissioner Zasuwa told the Commissioners that after 15 years of being on Planning Commission, he has decided to resign.
Commissioner Worrell asked for permission from the Commissioners to ask Mr. Lomako to look at revising the Home Occupation ordinance. She said she felt the ordinance was outdated. She explained that ZBA, at their last meeting was asked for an interpretation of the ordinance for a specific location and asked if open storage in the back of a pick-up truck would be considered a Home Occupation. Commissioner Worrell said she did not believe the case was presented clearly to ZBA and that they were not given thorough information on which to base their decision and stated if ZBA did not change their motion she believed the case would be taken to court.
Mr. Sapelak said he asked for an interpretation by the ZBA because a resident had open storage of salvage items, first in the yard and then in the back of a pick-up truck which most of the time was parked on Village property. He further explained that the resident was ticketed and at court it was decided that an interpretation of the ordinance was necessary.
Commissioner Worrell said that one interpretation will have an impact across the Village and stated if ZBA did not change their motion, the case would be taken to circuit court.
