The meeting was called to order by Chairman Heidt at 7:32 p.m. A quorum was present.

APPROVAL OF MINUTES
Regular Meeting December 11, 2008
PC-09-001 Keef moved, Worrell seconded, to accept the minutes of the Regular Planning Commission meeting of December 11, 2008 as presented. Motion CARRIED
CALL TO PUBLIC
Lawrence Hewitt, 883 General Motors Rd. was present to ask if garbage pick up from the dumpster for McDonalds is regulated. He said lately they have been emptying the dumpster at 4:00 a.m.
Mr. Sapelak said he would check the two previous site plans for McDonalds to see if there was discussion of the hours of operation. He said if nothing was found in the site plans, perhaps the nuisance ordinance could be enforced.
Mr. Hewitt also said that he has had a problem with being able to read the minutes on the Village website, saying that some of the months are missing.
Administration said they believed all the minutes were up to date, but would look in to his concern.
There was no further response from the Public.
PUBLIC HEARING
Ord. 231, Art. III,, Sec. 94-68 14 & 15, Principal Uses Permitted Subject to Special Conditions; Fire Station Development Requirements & Art. 1, Sec. 94-2, Definitions
PC-09-002 Worrell moved, Keef seconded, to open the Public Hearing at 7:38 p.m. Motion CARRIED
Mr. Lomako reviewed the language amendment in his letter dated 12/23/08, (on file at Village office).
There was no input from the Public.
PC-09-003 Keef moved, Amerman seconded, to close the Public Hearing at 7:42 p.m. Motion CARRIED
Commissioner Goodenow asked that Mr. Lomako confirm that the plan for the building would meet the requirements of the proposed language amendment.
PC-09-004 Amerman moved, Worrell seconded, to recommend to Village Council approval of the language amendment to Ord. 231, Art. III, Sec. 94-68, 14 & 15, Principal Uses Permitted Subject to Special Conditions; Fire Station Development Requirements & Art. I, Sec. 94-2, Definitions as proposed in Wade Trim letter dated 12/23/08. Motion CARRIED
UNFINISHED BUSINESS
Discussion – Recreational Vehicle Storage
Mr. Shufflebarger reported that at their last meeting Council did not approve the introduction of the language amendment to Sec. 94-344 (b), Recreational Vehicle Storage. He explained that he thought the general comments made by Council was that the ordinance was too restrictive with the requirement of fencing and screening, while being less restrictive with allowing vehicles to be stored in side yards. He said that Council did introduce the language amendment for the definition of Recreational Vehicle Storage.
The Commissioners, Mr. Shufflebarger, Mr. Sapelak and Mr. Lomako discussed the amendment and the current language.
PC-09-005 Worrell moved, Keef seconded, to suggest Planning Commission revisit the existing ordinance and proposed ordinance and work on blending the two together.
DISCUSSION
Commissioner Amerman said more direction from Council was needed.
Commissioner Goodenow said that he would not want to begin working on the language amendment without further direction from Council on how to proceed.
Commissioner Worrell expressed her concern of having residents being in “limbo” and not knowing how or where to store their recreational vehicles.

PC-09-005 Motion FAILS
PC-09-006 Goodenow moved, Keef seconded, to request administration and Wade Trim create a document for Council outlining the specific areas where direction is needed to attempt a re-write for Sec. 94-344. Motion CARRIED
PC-09-007 Amerman moved, Worrell seconded, to place Sec. 94-344, Recreational Vehicle Storage, back on the Planning Commission agenda for future consideration based upon input from Village Council. Motion CARRIED
Commissioner Worrell suggested to the audience that if they have any ideas or suggestions, they should submit them to Village administration.
CONSULTANT COMMENTS
Mr. Lomako reminded the Commissioners of the Public Hearing for the Master Plan to be held at the joint meeting between the Township Planning Commission and Village Planning Commission scheduled for January 29, 2009 at 7:30 p.m.
COMMISSIONER COMMENTS
Commissioner Goodenow reported that at the last Council meeting, Council introduced the proposed language amendment pertaining to fences Sec. 354, with the exception of (1) i., and amended the numbering of j through m to complete the ordinance. He reported that Council also had concern about the number of fences along a common property line. Commissioner Goodenow said at the December meeting he suggested to Mr. Shunia that he take elevations for the Papa Romano’s addition to the next Downtown Development Authority (DDA) meeting. Commissioner Goodenow said that did not happen and suggested that Planning Commission make it a condition for approval for those wanting site plan approval for projects in the DDA district to take the elevations to DDA for review.
