The meeting was called to order by Chairman Heidt at 7:30 p.m. A quorum was present.

APPROVAL OF MINUTES
 
Regular Meeting August 14, 2008
 
PC-08-041 Zasuwa moved, Worrell seconded, to accept the minutes of the regular Planning Commission meeting of August 14, 2008, as amended:
 
Page 1-2, first paragraph second line, “…and meet the setback requirement of 25’. Change to “…and meet the front yard setback requirement.
Second paragraph last line, “…period but would be…”, change to “…period, and would be…” Motion CARRIED
 
Regular Meeting September 11, 2008
 
PC-08-042 Keef moved, Johnston seconded, to accept the minutes of the regular Planning Commission meeting of September 11, 2008 as presented. Motion CARRIED

PUBLIC HEARING
 
Ord. #231, Art. XII, Sec. 94-344 (b), Recreational Vehicle Storage
 
PC-08-043 Zasuwa moved, Keef seconded, to open the Public Hearing at 7:35 p.m. Motion CARRIED
 
Mr. Lomako reviewed the proposed language amendment from the draft copy dated 9/30/08 (on file at Village office). He explained that from the previous draft the maximum width allowed for a recreational vehicle in a residential district was increased from 30’ to 40’ and a definition and diagram of a 5th wheel has also been included in the new draft.
 
There was no input from the Public.
 
PC-08-044 Zasuwa moved, Amerman seconded, to close the Public Hearing at 7:37 p.m. Motion CARRIED
 
Commissioners Keef and Zasuwa both felt that 40’ was excessive.
 
Chairman Heidt said he agreed.
 
Judy Paul, 778 Byron, was present and said that she thought that at the last meeting the language was changed from 30’ to 40’ and since there was no public comment tonight that meant the ordinance had passed.
 
Chairman Heidt explained the public hearing process and stated that once the Public Hearing was closed the Commissioners are still able to make changes they feel necessary. He allowed Ms. Paul to voice her concerns.
 
Ms. Paul explained that her recreational vehicle is stored on the side of her house and the length of the vehicle is not seen by those passing the front of her house. She said her neighbor on the side has no problem with her storing her vehicle on the side. She explained that she checked the ordinance requirements of other communities and found that some have no size restriction at all. She said she called the dealer who she purchased her vehicle from and was told that people aren’t buying 30’ units, she said she was told that 80% of the recreational vehicles purchased were units over 30’. Ms. Paul said that if the Village were to start restricting what people can and can’t do on their property, people won’t want to live in Milford.
 
Chairman Heidt said that after hearing that 80% of recreational vehicles purchased were units over 30’, he didn’t think 40’ was excessive.
 
Commissioner Keef said that he’s talked with a lot of Village tax payers who do not want to see greyhound type vehicles, or vehicles that basically look like busses, stored on residential properties.
 
Commissioner Johnston asked how it was determined to allow a five year grace period for residents to comply with the ordinance. He said he thought the amount was excessive.
 
Mr. Lomako explained that if a resident cannot comply by moving their vehicle to the side or rear yard immediately they would be given the grace period to comply.
 
Commissioner Johnston said he would be agreeable to a two year grace period. He asked that when the ordinance was adopted by Council, how residents would be notified.
 
Mr. Shufflebarger said it is not a requirement for the residents to be notified, but a courtesy letter may be sent to inform them of the amendment and the grace period.
 
PC-08-045 Amerman moved, Zasuwa seconded, to recommend to Village Council the approval of Ord. #231, Art. XII, Sec. 94-344 (b), Recreational Vehicle Storage as presented in the 9/30/08 Wade Trim draft with the modification of item 4 (d), from the maximum of a five (5) year grace period to a maximum of a (2) year grace period.

PC-08-048 Amerman moved, Worrell seconded, to recommend to Village Council the approval of Ord. #231, Art. XIII, Sec. 94-354, Fences & Art. I, Sec. 94-2, Definitions as presented in the 9/30/08 Wade Trim draft. Motion CARRIED

Mr. Lomako reviewed the language amendment in his letter dated 9/23/08, (on file at Village office), explaining that the proposed amendment would allow the Zoning Administrator to grant a one year extension of completion provided the owner/developer show due cause for the extension in writing.
 
There was no input from the public.
 
PC-08-050 Worrell moved, Zasuwa seconded, to close the Public Hearing at 8:08 p.m. Motion CARRIED
 
PC-08-051 Keef moved, Amerman seconded, to recommend to Village Council the adoption of Ord. #231, Art. XIII, Sec. 94-386, Period of Completion and Extension of Project Completion Deadline. Motion CARRIED
 
UNFINISHED BUSINESS
 
Proposed Zoning Ordinance Text Amendments Resulting from PA 110 of 2006 (Michigan Zoning Enabling Act): Installment 1: Public Hearing Notification Procedures
 
Mr. Lomako reviewed his letter dated 8/21/08, (on file at Village office), explaining the attempt to take the state statue and bring it to our ordinance. He said the first installment would address Public Hearing Notification Procedures. Mr. Lomako reminded the Commissioners that at their last meeting there was concern as to how to present the amendments to Council for adoption. He recommended waiting to set a Public Hearing and review future installments to find a “bundle” of amendments suitable to hold a Public Hearing.
 
Mr. Shufflebarger said if other changes were similar there would be no reason not to send several amendments together to Council for approval.
 
NEW BUSINESS
 
Proposed Zoning Ordinance Text Amendments Resulting from PA 110 of 2006 (Michigan Zoning Enabling Act): Installment 2: Conditional Zoning
 
Mr. Lomako reviewed his letter dated 9/24/08, (on file at Village office). He explained that this second set of amendments pertain to Conditional Zoning and stated that adopting the amendment would be an attempt to create a “place holder” within the zoning ordinance. He explained that this amendment is not a requirement but would be a worthwhile tool to have in the ordinance.

Mr. Lomako reviewed the proposed amendment from his letter dated 10/31/08, (on file at Village office).
 
The Commissioners, Mr. Shufflebarger and Mr. Lomako discussed the proposed amendment and what affect it could have on other residential districts.
 
They continued to discuss the following: A definition to define “hose drying” should be included in the amendment. The time frame of construction. The definition of essential services does not include buildings. Lot coverage only pertains to the building size and not the portion of the property that may be covered in asphalt. The size of any proposed fire fighting and rescue apparatus. What the height of a training tower would be. What type and how vigorous the training on site would be. Signage.
 
Mr. Lomako said he would come to the next meeting with corrections to the ordinance and supplemental information.
 
CONSULTANT COMMENTS
 
Mr. Lomako told the Commissioners that the 63 day deadline ends on 11/19/08 for those who were sent the draft copy of the Master Plan to respond with comments. He explained that the Township Planning Commission requested a revision to the draft Master Plan as stated in his 11/3/08 letter (on file at Village office). Mr. Lomako said the Township Planning Commission wanted to be sure the Village Planning Commission had the same opportunity as an independent Commission to make changes if desired. He suggested that Planning Commission bring any comments they may have regarding the draft Master Plan to the next meeting in December. Mr. Lomako reported that he and Building Official, Randy Sapelak met with the new architect hired by Papa Romano’s to revise their site plan. He said there has been a significant change made from the previous plan submitted and believes it may be back before Planning Commission for the December meeting.
 
COMMISSIONER COMMENTS
 
Commissioner Keef said he spoke with Commissioner Goodenow regarding the Bike Trail and an area that has been cleared for what looks to be a parking lot.
 
Mr. Shufflebarger said that currently a section has been cleared and is being used as a staging area for equipment. He said at some point they may want to change that area into a parking lot, at which time something will be submitted to Planning Commission for review.
 
Commissioner Amerman said she heard a rumor that Kroger is hoping to expand into the two lease spaces adjoining their store.
 
Commissioner Zasuwa asked what exactly Chairman Heidt had done that allowed the Fire Department to only have to use 5’ of park land for their new station.
 
Chairman Heidt said he sketched a plan using diagonal parking.
 
Chairman Heidt said that he and Commissioner Worrell attended a parliamentary procedure workshop in Wixom which was very good. He said he didn’t see in any way the Village Planning Commission isn’t following procedure.
