The meeting was called to order by Chairman Heidt at 7:33 p.m.  A quorum was present.

APPROVAL OF MINUTES
 
Regular Meeting February 14, 2008
 
PC-08-10 Amerman moved, Zasuwa seconded, to accept the minutes of the regular Planning Commission meeting of February 14, 2008, as amended: Page 1-3, second sentence, “…found it very extremely…” remove very. Motion CARRIED

UNFINISHED BUSINESS
 
SP-07-07, MacDonell Associates Architects, 16-11-204-008 & 16-11-204-029, Proposed Construction of New Liquor Store and Gas Station
 
Craig MacDonell, Architect, 312 E. Liberty and Ramzy Karmo, owner, 1330 E. Commerce were present to answer any questions from the Commissioners.
 
Mr. Sapelak went through the five outstanding items in the review letter from Planning Consultant, Nick Lomako dated 3/10/08 (on file at Village office).
 
Mr. MacDonell addressed each item from the review letter.
 
The Commissioners, Mr. Sapelak, Mr. MacDonell and Mr. Karmo further discussed the following: Whether the loading area is adequate for truck maneuvering. The hours of operation will be 6:30 a.m. to 1:00 a.m. with general deliveries during off peak hours and fuel delivery being after hours of operation. Until it is determined what gas station will be at the site, designs for the sign are not available nor are colors that may be on the façade of the building. Landscape material to be used should be on the site plan. An underground irrigation system will be used. The areas that are to have sod should be indicated on a revised plan. The adjacent driveway on the northwest corner is noted on the plan to have a 5’ radius and it should have a 10’ radius. The panels on the front elevation should be anodized and not painted metal. Catch basin concerns will be covered under engineering review.
 
Amber Ross, 1238 E. Commerce, adjacent property owner, said that she would like the entire retaining wall that will abut her property be a brick imprint pattern.
 
PC-08-11 Goodenow moved, Amerman seconded, to conditionally approve SP-07-07, subject to the following items, the first five being from the Wade Trim review letter of 3/10/08:
1. The petitioner will obtain a placement variance for the canopy to be installed as proposed.
2. The petitioner will obtain a 10’ rear yard setback variance from the 20’ rear yard setback requirement.
3. Planning Commission has determined that the loading area does meet the intent of the ordinance requirement, however, a delivery traffic layout must be submitted for administrative approval for all delivery trucks, specifically for the fuel tankers.
4. The revised site plan should include a note that the monument will be in full compliance with Sec. 94-350 of the ordinance, which will ensure the changeable copy area of the sign will not exceed 20 percent of the total sign area.
5. The plant material illustration should be corrected on a revised site plan to match the type and quantity on Sheet L-801. It should also be noted what the landscape material is between the sidewalk and the curb, and identify the landscape material at the northwest portion of the property. Underground irrigation will also be provided. The applicant agreed to replace three evergreen trees with three deciduous ornamental tress to provide seasonal interest.
6. The curb cut immediately adjacent to the property on the west should be changed to a 10’ radius.
7. The retaining wall on the south and west property line to be brick imprinted poured concrete on both sides, including the dumpster surround with final design being subject to administrative approval.
8. The panels on the front of the building should not be made of wood or painted metal, revision subject to administrative approval.
9. This approval does not act as a guarantee of capacity of the Wastewater Treatment Plant for the plans in question. Allocation of taps will be on a first come first serve basis at the time of building permit application.
 
DISCUSSION
 
Commissioner Murad asked if the relocation of the catch basin should be a condition of approval.
 
Chairman Heidt said the catch basin would be subject to final engineering review.

Discussion – Billboards, Sec. 94-337 (f) (1)
 
Commissioner Goodenow reported that he attended the last Council meeting and told Council that Planning Commission would not be able to have the billboard on Summit Street removed, but Council could move forward to have the billboard removed with assistance from the Village attorney if there was interest. Commissioner Goodenow said he did not believe Council was interested in pursuing the subject.
 
Ord., #231, Art. XII, Sec. 94-344 (b), Recreational Vehicle Storage
 
The Commissioners reviewed the pictures provided in the February packet and discussed which recreational vehicles were stored in areas they felt would be permissible with some type of screening as well as those stored in areas that would not be permissible. They also reviewed an RV Storage and Screening ordinance for the City of Bellevue, WA, provided by Mr. Lomako (on file at Village office).
 
There was a consensus from the Commissioners that the ordinance for the City of Bellevue was very clear and easy to understand as was the handout for the Public.
 
PC-08-12 Amerman moved, Zasuwa seconded, to request Wade Trim to draft an ordinance revision regarding recreational vehicle storage and screening based on the City of Bellevue ordinance and consider creating a handout based on the City of Bellevue document to go along with the ordinance for Public use. Motion CARRIED
 
NEW BUSINESS
 
Zoning Ordinance Compliance With PA 110 of 2006
 
PC-08-13 Goodenow moved, Johnston seconded, to postpone discussion of Zoning Ordinance Compliance with PA110 of 2006 until the April meeting. Motion CARRIED
 
ADMINISTRATIVE COMMENTS
 
Mr. Sapelak reminded the Commissioners of the joint Planning Commission study session with the Township Planning Commission on 3/26/08 at 6:30 p.m. Mr. Sapelak reported that he sent Mr. Lomako definitions of what he had compiled regarding definitions of fences along with possible additions to the ordinance. He also reported that Perry Sinacola, owner of Milford House Bar & Grill and James Eppink of J. Eppink Partners, Inc., 39 S. Main, Clarkston, met with him and Village Manager Arthur Shufflebarger to discuss outside seating at the restaurant. He explained that Mr. Shufflebarger informed Mr. Sinacola that he would approve outside seating for not more than 16 seats and if he wanted more than 16 seats Mr. Sinacola would have to go before Planning Commission. Mr. Sinacola indicated that he would like to put 60 seats in the patio area of the restaurant and have live entertainment. Mr. Sapelak said he told Mr. Sinacola that if he were to seek approval for 60 seats from Planning Commission and receive approval he may expect to pay additional tap fees as well as have to pay an additional amount into the parking fund.
 
The Planning Commissioners agreed that a Public Hearing would need to be set to address concerns from the Public regarding the request for outside live entertainment. They agreed to wait for any submission from Mr. Sinacola and then decide if a Public Hearing should be set.
 
COMMISSIONER COMMENTS
 
Commissioner Goodenow suggested that Chairman Heidt write a letter of “thanks” to the Friends of Milford Skate Park (FOMSP), for sending their letter updating Planning Commission on their activities. Commissioner Goodenow said that the Period of Completion language amendment should be adopted by Council at their next meeting. Commissioner Goodenow said he attended a Huron-Clinton Metropark Boardmeeting and said that they offered to put together a group to help the Fire Department with choosing a location for a new station but would first like to see pictures of the proposed station.
 
Commissioner Murad said he saw a “For Sale” sign at the Uptown Village of Milford site on N. Milford road and asked if administration knew if that was for the whole site and if it were purchased by a new developer would they need to come back to Planning Commission.
 
Mr. Sapelak said the sign was most likely for the entire site and that the approved site plan would sell with the property. He said it would be likely that a new developer would want to change the design of the buildings and would then need to come before Planning Commission.
 
Commissioner Goodenow suggested that once the Period of Completion language amendment has been adopted by Council administration should send out a copy of the language to all local builders in town.
