PUBLIC HEARING
Consider 2011-12 Village Budget
CM-05-052-11 Heer moved, Aubry seconded, to open the Public Hearing at 7:31 p.m. to discuss 2011-12 Village Budget. Motion CARRIED.
Ms. Jacques gave a brief overview of the proposed 2011-12 Village Budget. The proposed tax millage rates are 3.4931 mills for general operations and 2.8210 mills for refuse collection. An additional 1.747 mills will be levied in the DDA District.
CM-05-053-11 Aubry moved, Heer seconded, to close the 2011-12 Village Budget Public Hearing at 7:40 p.m. Motion CARRIED.
Consider 2011 Special Parking District Assessment
CM-05-054-11 Heer moved, Aubry seconded, to open the Public Hearing at 7:41 p.m. to discuss the 2011 Parking District Special Assessment. Motion CARRIED.
Mr. Shufflebarger stated the Parking Authority determines the deficiencies based on the Zoning Ordinance requirements and what each property provides. The rates are the same as previous years, $55 per deficient parking space and $140 base fee charged to each property for maintenance. There were no oppositions received.

NEW BUSINESS
Adopt 2011-12 Village Budget Resolution
CM-05-056-11 Heer moved, Aubry seconded, to adopt the 2011-12 Village Budget resolution as follows:

2011-2012 BUDGET
Whereas, pursuant to MCLA 141.412 and .413, notice of a public hearing on the proposed budget was published in a newspaper of general circulation on April 7, 2011, and a public hearing on the proposed budget was held on May 2, 2011, and
Whereas, the Milford Village Council shall cause to be levied and collected the general property tax on all real and personal property within the Village on the 2011 tax roll an allocated millage of 3.4931 mills for general operations; and 2.8210 mills for refuse collection, and
Whereas, the Milford Village Council shall cause to be levied and collected the Downtown Development Authority (DDA) property tax on all real and personal property within the DDA district on the 2011 tax roll an allocated millage of 1.747 mills,
Therefore, be it resolved that the Milford Village Council does hereby appropriate the following amount for expenditures for the 2011-2012 fiscal year:

Establish 2011 Special Parking District Assessment
CM-05-057-11 Heer moved, Aubry seconded, to establish the 2011 Parking District Special Assessment (on file in Village office), totaling $25,245.00. Motion CARRIED.
Approve Milford Memories 2011 Event Request
Milford Memories to be held on August 12-14, 2011. Huron Valley Chamber personnel and members of the Executive Board were present to answer any questions. Before voting, Aubry advised Council he was on the Milford Memories Steering Committee.
CM-05-058-11 Heer moved, Kovach seconded, to approve dates, hours, street closure dates, streets for closure, signage, the Village in-kind donation of $1,500 and alcohol sales in the park as presented on page 2 of this request, contingent upon a certificate of insurance listing the Village as additional insured and proper LCC approvals. Motion CARRIED.
Consider Request from Civil War Encampment Committee
CM-05-059-11 Kovach moved, Heer seconded, to approve the cannon firing at 10:00 p.m. on Saturday, August 13, during Milford Memories. Motion CARRIED.
Consider Recommendation of Liquor Licensing Review Committee for 525 N. Main St.
CM-05-060-11 Kovach moved, Heer seconded, to adopt the list of findings offered by the LLRC dated April 19, 2011 and approve the requested liquor license transfer for 525 N. Main St., Suite 200, Ruggles Café. Motion CARRIED.
Adopt Resolution to Place 2010 Delinquent Water/Sewer Bills on 2011 Tax Roll
CM-05-061-11 Aubry moved, Heer seconded, to adopt the resolution to place the unpaid accounts on the 2011 tax roll. IT IS HEREBY RESOLVED, that all real property parcels appearing on the delinquent water/ wastewater list, held by the Clerk for the Village of Milford, dated April 27, 2011, in the amount of $2,065.29, are hereby specifically assessed for arrearages and charges attributable to said parcels on the Village Clerk’s listing; said assessments to be placed on the 2011 Village tax roll. Motion CARRIED.
Dollar amount in resolution decreased to payment on account.
Adopt Resolution to Place 2010-11 Delinquent Invoices on the 2011 Tax Roll
CM-05-062-11 Aubry moved, Heer seconded, to adopt the resolution to place the unpaid invoices on the 2011 tax roll. IT IS HEREBY RESOLVED, that all real property parcels appearing on the delinquent invoice list, held by the Clerk for the Village of Milford, dated April 27, 2011, in the amount of $960.00, are hereby specifically assessed for arrearages and charges attributable to said parcels on the Village Clerk’s listing; said assessments to be placed on the 2011 Village tax roll. Adopt Highland/Milford Transportation Program Zero Tolerance Policy
CM-05-063-11 Heer moved, Kovach seconded, to adopt the Highland/Milford Transportation Program Zero Tolerance Policy as required by SMART and DOT. Motion CARRIED.
Approve Street Line Painting Proposal
CM-05-064-11 Kovach moved, Heer seconded, to waive the normal bidding process and use P.K. Contracting for our line painting program at the rate of $0.115/LF, along with half of the mobilization cost of $1,750.00. Motion CARRIED.
Approve Sale of Used 2000 GMC Pick-up Truck
CM-05-065-11 Heer moved, Aubry seconded, to approve the sale of the used 2000 GMC pick-up truck on EBay. Motion CARRIED.
CALL TO THE PUBLIC
There was a request from the Civil War Encampment Committee to clear some of the brush along the Huron River edge to enable a better view of the night cannon firing. Mr. Shufflebarger requested the gentleman contact him at the office to discuss further.
Jim Crane came before Council as a citizen (not as the attorney for the Lee Home) to comment on the restriction of alcohol sales in an Office District, specifically the clarification of not allowing a liquor license in the district. The ordinance currently does not allow the sale of alcohol in the Office District (which would require a liquor license). He felt clarifying the “sale of alcohol” versus the “consumption of alcohol” would allow events that have catering or functions serving alcohol to take place without confusion. Council stated their intention was to not allow a liquor license in the Office District however, catered events serving alcohol could take place.
MANAGER’S REPORT
Mr. Shufflebarger reminded Council of the Huron Valley Chamber of Commerce open house to be held May 18, 2011. He also stated the Household Hazardous Waste day was scheduled for Saturday, May 21, 2011.
COUNCILMEMBERS REMARKS
Kovach commented on the possible millage being placed on the ballot for the construction of the skate park. He was not in favor of the Village loaning land for the skate park and then also taxing the Village people. He requested the situation be reevaluated. Council concurred and requested discussion be placed on a future agenda.
Ziegler wished President Rusas well after her recent injury.
Frankford reminded everyone of the Relay for Life event to be held Saturday, May 7, 2011.
