President Rusas called the meeting to order in the Milford Civic Center at 7:30 p.m. President Rusas led the Pledge of Allegiance.

NEW BUSINESS
Consider Conditional Use Permit SUP-10-01, Kroger Gas Station
Will Curry, SSOE Group, representing Kroger, was present to answer questions from Council. He advised Council since their last meeting the site layout was changed per request of Planning Commission, a traffic study was conducted, and an environmental agreement has been adopted for the installation of the fuel station.
CM-07-116-10 Kovach moved, Glagola seconded, to allow Councilmember Frankford to abstain from discussion and voting as she is an employee of Kroger. Motion CARRIED.
Mr. Shufflebarger stated there were environmental agreements, with Kroger and through BCI. With these the initial plans are reviewed, the installation of the fuel station and ongoing monitoring. Hours of operation were discussed confirming the gas station would only operate in conjunction with Kroger’s hours of operation. The proposed hours are 6:00 a.m. to 11:00 p.m.
Kroger is required by law to notify of contaminant problems.
CM-07-117-10 Kovach moved, Heer seconded to approve the conditional use permit SUP-10-01, Kroger Gas station. Motion CARRIED.
Adopt Fire Department Ground Lease between Village of Milford and Charter Township of Milford / Approve Discharge of Original Ground Lease from 1959
CM-07-118-10 Heer moved, Glagola seconded to approve the new Fire Department ground lease between Village of Milford and Charter Township of Milford and discharge of the original ground lease from 1959.
Council requested the definition be more specific of “Fire Department purposes” on page 1 of the agreement. There was concern the property could be used for storage of equipment and not a station. Council felt the property should come back to the Village if it is no longer needed as a fire hall.
Mr. Kelley suggested wording the agreement stating after no activity for a period of twenty four months, the property would come back to the Village.
CM-07-119-10 Aubry moved, Ziegler seconded to postpone action to allow attorney to prepare new language. Motion CARRIED.
Approve Roof Bid for Wastewater Treatment Plant / Approve Roof Bid for Department of Public Services
Kovach requested the two roof bids be packaged together, resulting in one bid for both and a possible reduced cost. There was concern with comprising the bidding process.
CM-07-120-10 Kovach moved, Ziegler seconded, to directed Administration to package the two roof bids as one and set a target price not-to- exceed $53,000. Motion CARRIED.
Approve Non-Union Wages and Benefits
CM-07-121-10 Kovach moved, Glagola seconded to approve non-union wages and benefits as outlined. Motion CARRIED.
- There will be no wage adjustment (no wage increases).
- Non-union employees will pay 5% of the health care insurance premium for their selected health care coverage.
- The Village contribution to 401K retirement benefits be reduced from 10% of salary to 5%. The existing 2% match would remain in- place.
- Sick Leave - Change total accrual to 50 days (400 hours) (currently 100 days). - Insurance (related to sick time change)
- Village will provide short- term disability effective on 31st day of leave (effective date October 1).
CALL TO THE PUBLIC
Anthony Raimondo, 638 N. Main St., expressed thanks to Independence Day parade organizers. He announced South Hill Baptist Church will have free movie night July 10 and encourage pedestrians, bikers and drivers to share the roadways respectfully.
Garrett Steele, 2353 E. Commerce Rd, Milford, introduced himself to Council as a candidate for Township Clerk.

EXECUTIVE SESSION
CM-07-122-10 Kovach moved, Glagola seconded to go into Executive Session at 7:55 p.m. to discuss contract negotiations.
