NEW BUSINESS
Consider Approval of West Commerce Street Multi-Purpose Path Concept
Ann Barnette, DDA Director, spoke to Council regarding the DDA’s desire to extend the bike path from Hubble Pond Park to Main St. The DDA has been involved in the Milford trail project from the beginning, with the primary reason that Milford would be the only downtown trail head in Western Oakland County. This was a long term goal to benefit the downtown businesses. This has been included in the DDA plan, the TIF plan and is an Oakland County bike path sighting.
Ms. Barnette stated this extension would be considered a shared-use path. Other pathways have been considered, such as Liberty St. and along Huron/G.M. Road. Liberty St. via the Liberty St. underpass is not financially feasible at this time. The G.M. Road approach is twice the length of the proposed Commerce St. path.
Preliminary field inspection shows the path could be placed on the south side of Commerce Rd. with little impact. Ms. Barnette stated Commerce St. also works well because it is the center of town. Way-finding signs placed along the path direct people to downtown, which also makes it necessary to provide an easy, direct route.
Ms. Barnette stated she wanted to get Council’s approval on the concept, and then she would go to the residents to present a plan. She was requesting Council’s permission to use Village right-of-way for this path.
Discussion continued on the difference between a multi-use path and bike path. It was stated Planning Commission did not need to prepare new language for a multi-use path. However, discussion needed to take place on snow removal, since only sidewalks are addressed in the ordinance.
Estimated cost for the path was $50,000 vs. $1 million for the Liberty St. underpass. Ms. Barnette felt the Liberty St. underpass was still necessary, but could not happen for at least five years. There is also private funding of approximately $17,000 for the path, which reduces the amount needed from the DDA budget.
The next steps would be survey work, planning, design and engineering. Final work would not be done until residents were notified. The plan was to have the least amount of impact on the least amount of residents. The DDA Board would make final arrangements on the path after Council’s approval for use of the right-of-way.
CM-06-097-10 Kovach moved, Ziegler seconded, to approve the concept of an eight-foot wide multi-purpose path in Village right-of-way on the South side of Commerce St. between Peters Rd. and the West Municipal parking lot. Motion CARRIED.
Waive Bid Requirement and Approve Purchase of 911 Telephones
Mr. Shufflebarger stated this phone system purchase was discussed during budget sessions. The cost includes a $16,200 reduction from a grant. The Police Dept. would be able to cancel the order if the millage did not succeed in August.
Council questioned the discrepancies in the quoted price in the memo versus the quote submitted. The budget was originally set for $80,000 less the $16,000 grant, leaving $64,000 for the phone system. Mr. Shufflebarger stated the difference would come from the Police Dept. budget. The system is necessary if Dispatch is to be retained.
CM-06-098-10 Glagola moved, Ziegler seconded, to waive the bid requirement due to the Oakland County pre-bid, and approve the cost not-to- exceed of $70,971.21 as the police department portion for the purchase of one Vesta Pallas system from Advanced Wireless Telecom.
Discussion:
Kovach felt the bid amount should only be $69,643, based on the quote of $85,939 less the grant of $16,200.
CM-06-099-10 Glagola moved, Ziegler seconded, to amend motion reducing the purchase amount to $70,000 as the Police Department portion.
Mr. Shufflebarger stated he would provide an explanation from the Chief on the difference in costs.

Approve Tri-Party Agreement
CM-06-100-10 Kovach moved, Frankford seconded, to approve North Milford Road paving as the Village of Milford 2010 Tri-Party project. Motion CARRIED.
President Rusas explained these funds could only be used on road projects in conjunction with Oakland County. This year’s allocation is $194.00.
Adopt Medical Marijuana Six Month Moratorium
CM-06-101-10 Glagola moved, Frankford seconded, to adopt resolution to impose a temporary marijuana moratorium for a period of six months. Motion CARRIED.
Approve Sewer Rehab Project Amendment
Mr. Shufflebarger stated the project is near completion. The additional money will fix final problems found. The thirty day extension was requested by the contractor however it was expected the contractor would be done before the end of the month.
CM-06-102-10 Glagola moved, Heer seconded, to approve the additional $6,400 to be paid from the Capital Improvements Bond for sanitary sewer rehabilitation and approve an additional thirty day completion for the contractor. Motion CARRIED.
Approve Coratti’s Request for Outdoor Liquor Sales for 2010 Milford Memories
CM-06-103-10 Kovach moved, Frankford seconded, to approve to approve outdoor alcohol sales for DMP Pubs, LLC, Coratti’s, 335 N. Main for August 13-15, 2010. Approval is subject to LCC conditions and any approval and additional direction by the Milford Memories committee. A certificate of insurance must be provided to the Village Clerk listing the Village of Milford as additional insured. Motion CARRIED.
CALL TO THE PUBLIC
Rusas asked if there was anyone who wished to address Council on an item that was not on the agenda.
Pam Jackson, 5736 Lancaster Lane, Commerce Twp., introduced herself to Council as a candidate for the State Senate.
MANAGER’S REPORT
Mr. Shufflebarger gave Council an update on the Dam accident. The individual did survive.
Upcoming events included free fishing weekend, fireworks at Kensington on June 12 and the DSO at Kensington on June 25.
COUNCILMEMBERS REMARKS
Frankford commented on the Township closing on Friday’s at 4:00 p.m. and wanted to know if it was beneficial for the Village to do the same. Mr. Shufflebarger stated this could be a nice off-set with the recent reductions to be taken by the employees.
Frankford noticed the original minute books from the 1800’s were in disrepair. She would like permission to investigate purchasing acid-free jackets and possibly having the books refurbished. She will get more information to present to Council.
Glagola noted the Memorial Day parade this year only used five officers, a reduction from twelve last year.
Aubry wanted to make sure the road patches recently done in front of 320 W. Huron and 325 S. Main were going to be repaired correctly. Mr. Shufflebarger stated as a routine cold patch is done first, then a permanent patch at a later date. He added the gas company is very good about making these repairs.
