PUBLIC HEARING
Consider 2010/2011 Village Budget
CM-05-073-10 Heer moved, Glagola seconded, to open the public hearing to consider the 2010/2011 Village budget at 7:30 p.m. Motion CARRIED.
Ms. Jacques presented a summary of the 2010/2011 proposed Village budget (copy on file in Village office). She reported the 2010/2011 millage rate on taxable value would remain the same at 3.4931 mills for general operation and 2.0029 mills for refuse collection. An additional 1.747 mills will be levied in the DDA District.
Tax revenue has decreased significantly and expected to do the same next year. State Revenue sharing has gone from approximately 30 percent to 20 percent.
The Police Department budget was based on General Motors tax reduction of 40 percent and the passage of the .8 mills in the August election. If the .8 mills are approved, the Police Dept. would be able to maintain an eighteen officer department.
Ms. Jacques briefed Council on the cuts made in the budget which included non-union employee contributions to insurance, decreases in pension, and no raises.
Ms. Jacques explained the refuse collection revenue shortage and the need for the special assessment to cover the contract cost for the next two years.
Holly Brandt asked if the refuse collection fee was based on property values versus special assessments, as in the Township. Ms. Jacques confirmed that 2.0029 mills was collected on each property for refuse collection.

Consider 2010 Special Parking District Assessment
CM-05-075-10 Glagola moved, Kovach seconded, to open the public hearing to consider the 2010 Special Parking District Assessment at 7:40 p.m. Motion CARRIED
Mr. Shufflebarger stated the Parking Authority determines the deficiencies based on the Zoning Ordinance requirements and what each property provides. The rates are the same as previous years, $55 per deficient parking space and $140 base fee charged to each property for maintenance. There were no oppositions received.

Aubry inquired whether the grant money of $16,000 was removed from the Police Department capital outlay. Ms. Jacques confirmed it had been.

Whereas, pursuant to MCLA 141.412 and .413, notice of a public hearing on the proposed budget was published in a newspaper of general circulation on April 1, 2010, and a public hearing on the proposed budget was held on May 3, 2010, and
Whereas, the Milford Village Council shall cause to be levied and collected the general property tax on all real and personal property within the Village on the 2010 tax roll an allocated millage of 3.4931 mills for general operations; and 2.0029 mills for refuse collection, and
Whereas, the Milford Village Council shall cause to be levied and collected the Downtown Development Authority (DDA) property tax on all real and personal property within the DDA district on the 2010 tax roll an allocated millage of 1.747 mills,
Therefore, be it resolved that the Milford Village Council does hereby appropriate the following amount for expenditures for the 2010-2011 fiscal year

Establish 2010 Special Parking District Assessment
CM-05-079-10 Heer moved, Kovach seconded, to establish the 2010 Parking District Special Assessment (on file in Village office), totaling $25,377.00. Motion CARRIED
Approve Milford Memories 2010 Event Request
CM-05-080-10 Kovach moved, Frankford seconded, to allow Council members Aubry and Glagola to abstain from discussion and voting as they are decision makers on the Milford Memories Steering Committee and this would be a conflict of interest. Motion CARRIED.
CM-05-081-10 Kovach moved, Heer seconded to approve the dates, hours, street closure dates, streets for closure, signage, and alcohol sales in the park as presented for Milford Memories 2010, contingent upon a certificate of insurance listing the Village as additional insured and proper LCC approvals. Motion CARRIED.
Consider In-Kind Donation Request for Milford Memories
Laura Bolyard, Huron Valley Chamber of Commerce, spoke to Council regarding their request of $3,500 in-kind donation for Milford Memories. She stated this was a three day event that brought thousands of people to the Village, as opposed to a one-hour parade. She added the costs are high, even with the hundreds of volunteers they get each year.
Ms. Bolyard explained the Chamber would not be able to help other groups in the Huron Valley area through donations if they had to absorb all the costs. Council did not feel comfortable with their in-kind donation being used toward other donations.
CM-05-082-10 Kovach moved, Ziegler seconded to approve an in-kind donation of $1,500 for the three day Milford Memories event. Motion CARRIED.
Heer felt comfortable with a larger donation of $3,000, since this a large event. Frankford was in favor of the event, however felt the event was detrimental to a majority of the businesses.
Ms. Bolyard felt more good came from the event than bad. She added other community groups are able to raise money through the event. Mr. Shufflebarger stated the event is very desirable.
Sheila Maxwell, 914 Panorama, enjoyed event, however with recent lay-offs and cuts, she as a taxpayer would not be in favor of a $3,000 donation.
Anthony Raimondo agreed that the money should stay in the Village. Ms. Bolyard explained the Chamber was for the Huron Valley area, not just Milford.
Adopt Resolution 10-003 Resolution of Intent, Establishment of a Special Assessment District for Refuse Collection Services within the Village
Mr. Shufflebarger stated the refuse collection revenues are not keeping up with the costs, therefore it is necessary to set a special assessment of $54.00 for each property. He added that South Hill Apartments does not participate in the refuse collection tax and the Village will be negotiating separately their participation in the assessment.

RESOLUTION 10-003
COUNTY OF OAKLAND, STATE OF MICHIGAN
RESOLUTION OF INTENT
FOR ESTABLISHMENT OF A SPECIAL ASSESSMENT DISTRICT
FOR REFUSE COLLECTION SERVICES WITHIN THE VILLAGE
WHEREAS, the Village Council directed the Village Manager to prepare, or cause to be prepared, description and cost estimates for refuse collection service; and
WHEREAS, the Village Manager has generated a report which sets forth his recommendation as to what proportion of the cost should be paid by special assessment and what part, if any, should be a general obligation of the Village; the number of installments in which assessments may be paid; and the residential lots and properties which should be included in the special assessment district.
WHEREAS, the report of the Village Manager has been filed with the Village Clerk for presentation to the Village Council, and such report is available for public examination.
NOW, THEREFORE, BE IT RESOLVED that:
1. Village Council has reviewed and approved the Village Manager’s report which covers the plans and specifications for refuse collection service within the Village.
2. The Village Council has reviewed and approved the cost estimate for the refuse special assessment in the amount of $260,000.
3. The Village Council has reviewed and approved the estimated life of the refuse special assessment and has determined that the life span shall be two years.
4. The Village Council has reviewed and approved what proportion of cost shall be paid by special assessment upon the benefitted residential properties and determined that no costs shall be allocated as general obligations of the Village.
5. The Village Council has designated the lands upon which the special assessment shall be levied to include residential lots and properties that receive refuse collection service within the Village.
6. The Village Council has determined that no interest shall be charged on the special assessment.
7. The Village Manager shall be designated as agent for the Village Assessor, and is hereby directed by the Village Council to prepare a special assessment roll based upon the cost estimate of the refuse collection in the Village of Milford.
8. The Village Manager shall prepare a special assessment roll, including all residential lots and properties within the special assessment district designated by the Council, and the roll shall be filed in the Village Clerk’s office and made available for public inspection.
9. On May 17, 2010, Village Council shall review the assessment roll at a public hearing where all interested persons or parties shall be given an opportunity to be heard. Objections to the roll may also be filed in writing with the Village Clerk prior to the close of the hearing.
10. The public hearing scheduled to hear objections to the roll shall be properly noticed, stating the time and place of the hearing, and shall be published once in a newspaper circulated in the Village, not less than ten (10) days prior to the date of such hearing. The Notice shall also be sent by the Village Clerk first class mail to each owner of property subject to assessment.
11. Village Council may confirm the special assessment roll, as presented or revised. If confirmed, the roll shall be transmitted to the Village Treasurer for immediate collection.
12. All resolutions and parts of resolution, insofar as they conflict with the provisions of this resolution, are hereby rescinded.
Set Public Hearing for Refuse Collection Special Assessment District, May 17, 2010

Approve Audit Agreement with Plante & Moran
The agreement reflects a 20 percent reduction for the next three years.

Mr. Shufflebarger explained the need for single audits which are tied to Federal grants.

Rusas asked if there was anyone who wished to address Council on an item that was not on the agenda.

MANAGER’S REPORT
Report on Request form Civil War Encampment Committee
Mr. Shufflebarger stated the Civil War encampment committee requested permission to shoot the cannon once at night. He had denied their request because of the numerous complaints that are received when the cannon is shot during the day.
Bill Wall, Joan Spiroff and Gordon Peterson, members of the Civil War Encampment Committee, were present to explain their request, stating a night shooting was a spectacular sight and very popular. They stated the firing would be 100 percent safe. The committee tries to do something new each year. The committee was willing to get the word out to the people regarding the night shooting. It was agreed the public needed to be notified.
CM-05-085-10 Kovach moved, Ziegler seconded for the Manager to approve the cannon firing at 10:00 p.m. on Saturday night during Milford Memories. Motion CARRIED.
Mr. Shufflebarger reminded the Household Hazardous Waste Collection will take place Saturday, May 15, 2010 from 8:00 a.m. – 1:00 p.m.
COUNCILMEMBERS REMARKS
Glagola reiterated that the Chambers membership base includes the Huron Valley district from M59 to Pontiac Trail.
Aubry asked if a plan was in place to reduce costs for the Memorial Day parade. He also inquired whether notices were being given in regards to RV ordinance violations.
