Consider Amendment to Utilities Ordinance, Section 82-68, Delinquent Bills, Penalty; Notice
CM-03-036-10 Kovach moved, Glagola seconded to amend Ordinance Section 82- 68 to require a 30-day shut off notice instead of the current 90-day notice and allow the notice to be sent by first-class mail. Motion CARRIED.
A local Landlord spoke in favor of the reduced time, requesting less than a 30-day notice for renters.
It has been an administrative policy to also send out seven day and 48 hour notices. This policy will continue.
Consider Sidewalk Variance, 325 W. Huron
Don Green, Milford Township Supervisor, stated the reason they were looking for a variance was at the start of the project the Engineer, Wade Trim, told the Construction Engineer they did not have to install a sidewalk because the area did not meet ADA requirements. Because of this, the drive was placed with curbs. Mr. Green listed the $25,000 extras they have put toward the project.
CM-03-037-10 Kovach moved, Glagola seconded, to grant a waiver for the sidewalk construction at 325 W. Huron and require applicant to pay a total of $1,944.00 into the sidewalk fund.
Mr. Shufflebarger stated the Engineer did not have the authority to state the sidewalk was not necessary.
Council discussed the placement of the sidewalk and the fact there was new landscaping already in place where the sidewalk should go.
Rusas did not feel the sidewalk installation should be waived.
Jim Crane, 222 Clinton, spoke in favor of the placement of sidewalks.
Robert Calley, DPS Director, stated the grade of the location is an issue for placement; the sidewalk would have to go along the curb.
Mr. Green stated if they would have known they were required to place a sidewalk, they would not placed the landscaping and would have cut the curbs to be ADA compliant.

Approve Gravity’s Request for Outdoor Liquor Sales for 2010 Sidewalk Sales, Criterium and Milford Memories
CM-03-038-10 Kovach moved, Heer seconded, to approve outdoor alcohol sales for Questventures, Ltd., Gravity Bar and Grill, 340 N. Main for July 16-18, 2010; August 1, 2010; and August 13-15, 2010. Approval is subject to LCC conditions and any approval and additional direction by the MBA and the Milford Memories Committee. A certificate of insurance must be provided to the Village Clerk listing the Village of Milford as additional insured. Motion CARRIED.
Approve Purchase of Vactor Jet
Robert Calley, DPS Director, stated the maintenance scheduled for next year is projected at a cost of $75,400. He felt the trade-in cost was a good price, as opposed to trying to sell on ebay.
CM-03-039-10 Glagola moved, Kovach seconded to authorize the purchase of one VAC-ALL AVJ0810 from Southeastern Equipment Co., Inc Novi, Michigan, for the price of $266,000.00 less the $30,000.00 trade- in for a total cost of $236,000.00. Motion CARRIED.
Adopt Resolution for Baker Elementary
CM-03-040-10 Kovach moved, Glagola seconded to adopt resolution opposing closing of Baker Elementary.

RESOLUTION OPPOSING THE CLOSURE OF
BAKER ELEMENTARY SCHOOL BY
THE BOARD OF EDUCTION FOR
THE HURON VALLEY SCHOOL DISTRICT
At a regular meeting of the Village Council of the Village of Milford, County of Oakland, State of Michigan, held in the Village Offices in said Village on March 1, 2010 at 7:30 p.m., Eastern Daylight Time.

The following preamble and resolution were offered by Member _____________ and supported by Member ____________________________.
WHEREAS, the Superintendent for the Huron Valley School District has announced her intention to recommend to the Board of Education that Baker Elementary School be permanently closed in connection with Phase II of the Huron Valley Building Utilization Study.
WHEREAS, Baker Elementary School has served the community since 1953 as a neighborhood school in a residential zone within the downtown area of the Village of Milford; and
WHEREAS, the closing of Baker Elementary in a residential zone located within the downtown Village area will compound the problems currently faced by the community in regard to declining property values and the depressed economy, and will directly affect the financial and social welfare of the residents and businesses within the Village of Milford; and
WHEREAS, the closing of Baker Elementary would force the displacement of many children; and
WHEREAS, when the Huron Valley School District closed the former Milford High School building, the structure was left abandoned and neglected for over twenty years, directly affecting the financial and social welfare of the immediate residential properties and the Village community as a whole; and
WHEREAS, the Board of Education for the Huron Valley School District has not provided the community with information regarding the intended use, redevelopment, repurposing or disposition of the property and/or the building once Baker Elementary School has been closed; and
WHEREAS, the Village Council for the Village of Milford strongly urges the continued use of Baker Elementary School as a positive productive contributor to our community to support the neighborhood values historically represented by its many years of service.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF MILFORD:
1. That the Village Council of Milford strongly urges the continued use of Baker Elementary School as a positive productive contributor to our community noting:
A. The closing of Baker Elementary in a residential zone will compound the problems currently faced by the community in regard to declining property values and the depressed economy, and will directly affect the financial and social welfare of the residents and businesses within the Village of Milford.
B. The closing of Baker Elementary would force the displacement of many children.
C. No information has been supplied to the Village or its residents regarding the intended use, redevelopment, repurposing or disposition of the property and/or the building, and the Village fears that history will repeat itself and the structure will simply be left abandoned and neglected.
2. That the Village Council of Milford requests that the School Board for the Huron Valley School District postpone a final action for Baker Elementary School until a more thorough investigation can be performed and the necessary information can be provided to the public.
3. That a copy of this Resolution be sent to the Huron Valley School District Superintendent, the Board of Education for the Huron Valley School District, and to all municipal governing authorities within the Huron Valley School District.

Heer felt the paragraphs referencing the old Milford High School and the intended use of Baker Elementary should be removed, because she felt they were misleading.
Other Council members felt it important to send a message that the Village does not want another empty school building in the Village.
Parents of Baker students asked what impact the resolution would have on the School Boards decision. Rusas stated legally the Village has no impact.
The parents also expressed concerns with the possible closing of Muir Middle School and how devastating this would be to the community.
Approve Phone System Audit Agreement
Mr. Shufflebarger stated after investigation of other companies, it was learned that Oakland County had just awarded The Bahz Group a contract for a similar audit and the Village was able to “piggy-back” on their contract.
CM-03-041-10 Kovach moved, Glagola seconded to give authorization to the Clerk to work with Bahz Group, Inc. to conduct the Village of Milford phone system audit. Motion CARRIED.
Appoint Village Representative to Village/Township Police Review Committee
Rusas nominated Dale Feigley to the committee, stating he owns a business in the Village and is very involved in the community.
CM-03-042-10 Kovach moved, Glagola moved to appoint Dale Feigley as the Village Representative to the Village/Township Police Review Committee. Motion CARRIED.

MANAGER’S REPORT
Commerce Street Grant Application
Mr. Shufflebarger stated the Village was not awarded the Oakland County Federal Aid grant money for Commerce Rd. However, if more funds become available, the Village is already on the list and scored.
Water Well Study
Robert Calley, DPS Director, stated the wellhead and piping is installed. He added we are waiting for a permit from the MDEQ. He hopes, after testing, the well will be operational within two weeks.
COUNCILMEMBERS REMARKS
Kovach stated he was approached regarding the temporary signs placed in the downtown crosswalks, which are not considered official signs, and asked whether the Village would be liable if someone were to get hit.
Chief Wayne Walli stated the liability would still lie on the driver.
Rusas stated she received a request to send the ordinance amendments for the Cultural Arts Center language back to the Planning Commission with recommended changes. It was stated that a cultural arts center as currently defined without evening performances, can go in the office district.
