President Rusas called the meeting to order in the Milford Civic Center at 7:30 p.m. President Rusas led the Pledge of Allegiance.

Discussion:
Gary Goodenow stated the ordinance amendments were precipitated by the owner of the Stone Church on Commerce Rd., however he cautioned that the ordinances were not specific to the Stone Church. There currently is no language in the ordinance for Cultural Arts.
Mr. Goodenow stated the Planning Commission (P.C.) noticed the current Central Business District allowed as a principle use theatres, concert halls, assembly halls, etc., and the P.C. wanted this to be a special use. The ordinance amendments take these out of principle use and moves them and cultural arts to special use to trigger public hearings and Council approval. Amendment to the Office District language allows Cultural Arts as a special use in an Office District.
The language amendments do not affect dance studios. Theatres, etc. would still be allowed in the Downtown district, but would be considered a special use. The language does not have any effect on Churches. Milford Cinema would be grandfathered into amendments.
There is a seat limitation in the amendment for Cultural Arts, however, the P.C. has the option of approving additional seating.
Frankford questioned whether Commissioner Keef was on the Board of Directors for the Lee Home. Mr. Goodenow stated Mr. Keef had volunteered his past history with the Lee Home, but did not indicate he was still on the Board.
Tige Reader stated he and the owner of the Stone Church went to the Planning Commission for direction on uses for the location. He stated the Planning Consultant concurred that a Cultural Arts center would be a good use for the property.
CM-01-003-10 Kovach moved, Heer seconded to introduce Ordinance Amendments 231-140, 231-141, 231-142 and 231-143.
Jim Crane distributed to Council current Office District language. He spoke to Council regarding section fraternal organizations, churches and private clubs which are non-profit facilities. He stated the new language for cultural art centers would allow a bar or restaurant into the office district. He felt 100 seats would be a big impact in an office district. He felt a true cultural arts center could serve as a transitional zone, however he felt the proposed language was going to be a general business use.
Mr. Goodenow stated the parking for the Stone Church would be addressed during any site plan review.

CALL TO THE PUBLIC
Rusas asked if there was anyone who wished to address Council on an item that was not on the agenda.
Phil Harris, 169 Marlene, addressed Council regarding individuals parking at the south end of Marlene. He stated there is a paved turnaround pad that is being used for parking which blocks traffic turnaround. He stated he has contacted the Police Dept. several times with no response. His driveway is being used for turnarounds. Mr. Harris had contacted Jennifer Frankford and she had investigated the site. She thought there was a parking spot that they were entitled to use.
Mr. Shufflebarger stated he would look at the site plan and determine if area is a turnaround.
MANAGER’S REPORT
Mr. Shufflebarger stated the well in Central Park has been drilled, there will be a pumping test conducted and he hoped the well would be operational in three weeks.
Work will resume on the sewer rehab project in a week and should be complete in approximately three weeks.
Mr. Shufflebarger stated we are checking into a free email service Oakland County provides for notification purposes. It can be based on level of importance.
He reminded Council of Joint meeting on January 11 at 7:30, (7:00 for pizza) and the Budget session on January 13 at 7:00 p.m. The next Council meeting will be held Tuesday, January 19, 2010.
