President Rusas called the meeting to order in the Milford Civic Center at 7:30 p.m. President Rusas led the Pledge of Allegiance.

NEW BUSINESS
Adopt Resolution of Appreciation, Thomas D. Nader
Kovach read the following resolution into the record:
RESOLUTION OF APPRECIATION
NO. 09-009
WHEREAS, Thomas D. Nader, has served the Village of Milford and his community as a Councilmember from March 1995 to March 2005; and
WHEREAS, Mr. Nader was appointed as the Village Council President Pro-Tem in March 1999; and
WHEREAS, the residents of the Village of Milford elected Mr. Nader to serve as the Village President in March 2005 through September 2009.
THEREFORE, BE IT RESOLVED that at their Regular Meeting on September 21, 2009, the Milford Village Council on behalf of our residents extends their appreciation to Thomas D. Nader for his years of service to the Village of Milford.

Kovach read the following resolution into the record:

WHEREAS, Richard Kostin, has served the Village of Milford and his community as a Councilmember from March 2003 through September 2009; and
WHEREAS, Mr. Kostin during his time on Council, has also been an advocate for the Senior Center.
THEREFORE, BE IT RESOLVED that at their Regular Meeting on September 21, 2009, the Milford Village Council on behalf of our residents extends their appreciation to Richard Kostin for his years of service to the Village of Milford.
Introduce Ordinance No. 231-134, Recreational Vehicles
Gary Goodenow, Planning Commission, gave Council a synopsis of what changes were made to the ordinance.
CM-09-152-09 Heer moved, Ziegler seconded, to introduce Ordinance No. 231-134, Recreational Vehicles.
Residents and Council discussed concerns regarding the portion of the ordinance allowing RV’s to be parked in the front yard from May to September if unable to park in the rear or side yard, especially the impact to the historic district. The ordinance currently in place does not allow parking of RV’s in front yards. It was stated Council had the option to remove sections of the ordinance prior to adoption.

Accept Bid for Overband Crack Sealing
CM-09-153-09 Heer moved, Kovach seconded to accept the bid of $1.10 per lb. from Carr’s Outdoor Services to purchase and install overband crack sealing on our local and major streets. Motion CARRIED.
There will be a 2.5 percent discount if the contract is also awarded by the City of Wixom.
Approve Contract Amendment for Sanitary Sewer Rehabilitation Project
CM-09-154-09 Heer moved, Kovach seconded to approve sanitary sewer relining project Phase II and Phase III contract amendment from DiPonio & Morelli Construction in the amount of $65,580.00 to cover costs for nineteen additional manholes. Motion CARRIED.
CALL TO THE PUBLIC
Rusas asked if there was anyone who wished to address Council on an item that was not on the agenda.
Mr. Ed Bondy, 122 Turnberry Ct., asked for assistance from Council and the Village’s attorney in collecting money owed from an individual who damaged the front entrance to his subdivision, Boulder Hills Association. Mr. Connelly explained it was out of the Village’s jurisdiction once a conviction was made. He stated only the courts had the ability to force collection, i.e. the Judge and/or probation department. He suggested speaking with the Judge from this case and scheduling a show cause hearing.
Harley Maxwell, Peters Rd., congratulated and welcomed the new Council President and Councilmembers.
MANAGER’S REPORT
Report on OAKtober Festival
Mr. Shufflebarger stated the festival has been postponed until consideration for 2010.
COUNCILMEMBER REMARKS
Aubry inquired the status of the grass situation on Marlene St. Mr. Shufflebarger stated information has been requested from resident. After checking on the web-site regarding the designation, nothing has been found that gives the resident special considerations. The grass over the sidewalk has been cleared. Mr. Shufflebarger expects to have the grass cut in the right-or-way as well.
Kovach asked what the timeframe was for the millage recount. It was stated we should have a final decision by the end of Friday.
Ziegler congratulated Frankford, Aubry and Rusas.
Rusas also welcomed Aubry and Frankford.
