President Nader called the meeting to order in the Milford Civic Center at 7:30 p.m. President Nader led the Pledge of Allegiance.

CM-07-121-09 Rusas moved, Glagola seconded, to approve the July 20, 2009, consent agenda moving Sewer Use Request to New Business. Motion CARRIED.

NEW BUSINESS
Approve Application for Temporary Outdoor Service during Milford Memories, Coratti’s, 335 N. Main St.
CM-07-123-09 Rusas moved, Heer seconded to approve outdoor alcohol sales for DMP Pubs, LLC, Coratti’s, 335 N. Main for August 7, 8 & 9, 2009. Subject to LCC conditions and any approvals and additional direction by the Milford Memories Committee. A certificate of insurance must be provided to the Village Clerk listing the Village of Milford as additional insured. Motion CARRIED.

CM-07-124-09 Heer moved, Kostin seconded, to approve outdoor alcohol sales for Alashamen Corporation, Five Lakes, 424 N. Main for August 7, 8 & 9, 2009. Subject to LCC conditions and any approvals and additional direction by the Milford Memories Committee. A certificate of insurance must be provided to the Village Clerk listing the Village of Milford as additional insured. Motion CARRIED.
Approve Water System Project Change Orders
CM-07-125-09 Kostin moved, Heer seconded, to approve Change Order 4 to Kamphuis Pipeline Company for the water system improvements project. Motion CARRIED.
CM-07-126-09 Kostin moved, Glagola seconded, to approve Change Order 5 to Kamphuis Pipeline Company for the water system improvements project. Motion CARRIED.
CM-07-127-09 Glagola moved, Heer seconded, to approve Change Order 6 to Kamphuis Pipeline Company for the water system improvements project. Motion CARRIED.
Eric Harris, Wade Trim, stated they would be submitting the change orders into the State to try and get them rolled into the Drinking Water Revolving fund.
Report Updates of Projects
Eric Harris, Wade Trim, spoke about some of the more recent projects, i.e. Milford Trail, Peters Road Bridge and Water System, stating they are all near completion.
CALL TO THE PUBLIC
Nader asked if there was anyone who wished to address Council on an item that was not on the agenda.
Phil Harris, 169 Marlene St., asked for status of two items he addressed at the last Council meeting.
Mr. Shufflebarger stated the retaining wall was looked at by the Building Official, DPS Director and Credit Union Manager and stated there were plans to fix the crack that was allowing the drainage into his yard.
The Village’s insurance company declined to pay Mr. Harris’ co-pay for his wife’s injury on a sidewalk, stating the Village was not liable. Mr. Harris felt the sidewalk was defective and since the sidewalk was not cleared, that was neglect, and that the Village should cover the co-pay. Mr. Shufflebarger stated he had not heard whether the sidewalk was defective and restated that the sidewalk had been cleared within the 48 hour time period required after a snowfall.
Suzanne Grebe, Huron Valley Schools HOT Team, asked Council for permission to run an off-road triathlon event in the Village on October 4, at 10:00 a.m. The triathlon would include canoeing to Central Park, the mountain bike trail and running on the bike path. Proceeds would go to the HOT Robotics team. She is working to have HV Schools provide insurance certificate. They have two courses in mind, deciding factor being access to John R and the Benson trail extension. It would be necessary to close the Village portion of the bike trail for 3-4 hours during the event. Mr. Shufflebarger has been working with them to finalize plans.
CM-07-128-09 Rusas moved, Heer seconded, to authorize Village Administration to finalize agreement for the triathlon and the proposed use of Village facilities with report on final agreement to be made to village Council. Motion CARRIED.
