SPECIAL COUNCIL MEETING
MILFORD CIVIC CENTER
President Nader called the meeting to order in the Milford Civic Center at 7:30 p.m. President Nader led the Pledge of Allegiance.

Arthur Shufflebarger, Village Manager; Thomas Connelly, Village Attorney; Brian Slizewski, Village Engineer, Kenneth Vance & Mark Jaffray, ZBA Alternates
President Nader informed the public that the purpose of this meeting was to go into Executive Session to receive our attorney’s opinion regarding the Peters Road Bridge panels and Wade Trim offer. He stated Council will accept brief public comment at this time.
Edith Nader, 434 W. Huron, Susan Pogats, 516 W. Huron, said the original panels should be installed and Wade Trim should be made to pay all additional costs incurred due to the delay, removal and reinstallation of the panels.
Clay Jansson, 768 Ridgeside, read from a prepared statement. He said the wrong panels should be removed and the correct panels should be installed. He said Wade Trim should be made accountable.
Kenneth Vance, 405 Hickory, asked about the bridge being over budget, if the proposal currently offered by Wade Trim were to be accepted, would that money come to the Village or would some of it go to MDOT.
Shufflebarger said any monies or credits would be applied to the Village’s portion of the bridge expenses, not the State’s.
Harley Maxwell, 211 Peters, Bert Weening, 663 Mill Pointe, and Susan Jaffray, 639 Mill Pointe asked Council to accept Wade Trim’s offer and the panels as delivered and proceed with the bridge construction.
EXECUTIVE SESSION
Receive Attorney’s Opinion
CM-07-135-08 Kovach moved, Kostin seconded, to go into Executive Session at 7:40 p.m. to receive our attorney’s opinion.

CM-07-136-08 Kostin moved, Glagola seconded, to return to the regular Council Meeting at 8:09 p.m. Motion CARRIED
CM-07-137-08 Kostin moved, Glagola seconded, that for settlement purposes the Village has agreed to resolve this matter with Wade Trim in the amount of $160,000. Payment will be made by Wade Trim forgiving payment on past, current and future amounts due on the Peters Road Bridge Project and for up to $20,000 in profit on future projects up to a total amount of $160,000. Secondly, the Village will accept the incorrect panels of New England Dry Stack as the panels for the Peters Road Bridge.
