NEW BUSINESS
Adopt Ord. 231-129, DWRF Water Supply System Revenue Bonds, Series 2008
CM-07-127-08 Rusas moved, Heer seconded, to adopt Ordinance Amendment 231-129 (on file in Village office) an ordinance to amend Sec. 82 by adding new Sections 82-69 through 82-85(b) in order to provide for the construction, installation, furnishing and equipping of additions and improvements to the existing water supply system; to provide for the issuance and sale of revenue bonds to pay the cost thereof; to prescribe the form of the bonds; to provide for the collection of revenues from the system sufficient for the purpose of paying the costs of operation and maintenance of the system and to pay the principal of and interest on the bonds; to provide for the segregation and distribution of the revenues; to provide for the rights of the holders of the bonds in enforcement thereof; and to provide for other matters relating to the bonds and the system. Motion CARRIED
Decide on Panels for Peters Road Bridge
DISCUSSION
Shufflebarger provided a memo dated 7/16/08 (on file in Village office) that explained the project costs to date, the overages and suggestions to cover those overages. He also discussed the bridge panel substitution, which was due to a mistake made by the Village engineers. He said Wade Trim has offered to compensate the Village in the amount of $160,000. He recommended accepting Wade Trim’s proposed settlement and accept the panels as delivered.
Council, Shufflebarger and Connelly discussed the proposed settlement. Shufflebarger said the estimated cost to remove and replace the bridge concrete panels is $400,000 to $500,000. They discussed replacing the panels and the fact that stopping work to wait for the new panels to be cast would cause more delays; asking Wade Trim to pay those costs versus accepting the delivered panels and $160,000 being offered by Wade Trim at this time.
Susan and John Pogats, 516 W. Huron; Bonnie Mottaghi, 520 W. Huron; Kenneth Vance, 405 Hickory; Matthew Mazure, 947 Byron and Edith Nader, 434 W. Huron objected to the Village accepting the wrong panels and thought Wade Trim should pay to have them removed, reordered and replaced. Mrs. Nader provided Council with a prepared statement (on file in Village office).
CM-07-128-08 Rusas moved, Heer seconded, to direct Administration and Council to negotiate with Wade Trim and provide the information necessary to discuss possible litigation regarding the bridge panels during an Executive Session at the 8/4/08 Council meeting. Motion CARRIED
Approve Signage for W. Huron/Peters Road
Chief Walli presented his findings (on file in Village office) to Council regarding signage for W. Huron and Peters Road. He recommended no parking signs along streets as well as a No left-turn sign from 4:00 p.m. – 7:00 p.m. for traffic headed east on W. Huron to prevent them turning left onto W. Huron.
He said prohibiting left-turns from W. Huron going west onto W. Huron would cause traffic to circumvent the stop sign by going around and through the neighborhood to the east.
Shufflebarger said the Chief can install the signage through a Traffic Control Order that would be adopted by Council after thirty days.
Approve Coratti’s Request to Serve Alcohol Outdoors During Milford Memories
CM-07-129-08 Kostin moved, Glagola seconded, to approve outdoor alcohol sales for DMP Pubs, LLC, Coratti’s on Main, 335 N Main, subject to LCC conditions and any approvals and additional direction by the Milford Memories Committee. A certificate of insurance must be provided to the Village Clerk listing the Village of Milford as additional insured, policy dated Aug. 8, 9, & 10, 2008. Motion CARRIED
Set Non-Union Wages
CM-07-130-08 Kovach moved, Kostin seconded, to approve a 2.5% wage increase for the non-union employees retroactive to 7/1/08. Motion CARRIED
CALL TO THE PUBLIC
Nader asked if there was anyone who wished to address Council on an item that was not on the agenda.
Mrs. Nader asked where the cobble stones that had been removed from below the bridge were now.
Shufflebarger said he did not know.
Mrs. Pogats thanked Council for being candid with them. She also thanked the Chief, but stated she did not agree with his recommendation regarding signage.
There was no further input from the Public.
MANAGER’S REPORT
Shufflebarger reported that the easement agreements for the bike trail were done and that he expected a signed copy of the contract this week and then we could bid the job out. He said he hoped to have the bid award at the 9/2/08 Council meeting.
COUNCILMEMBER REMARKS
Rusas said she was asked by a resident what the Village could do about the power outages we have been having.
Shufflebarger said that the sub station on E. Lafayette was expanding and they would be installing a new circuit that is expected to take some of the load off of the existing system. He said that should help. Other than that, he said we have a liaison from DTE and he would be happy to ask him to come to Council.
Kostin said the cost of asphalt has gone up and it is almost as expensive as concrete. He said we should take that into consideration when we bid out the bike trail.
