REGULAR COUNCIL MEETING
MILFORD CIVIC CENTER
 
President Rusas called the meeting to order in the Milford Civic Center at 7:30 p.m. President Rusas led the Pledge of Allegiance.
 
PRESENT President Theresa Rusas; Councilmembers Jerry Aubry, Jennifer Frankford, Michael Glagola, Elizabeth Heer, James Kovach and Kevin Ziegler
 
ALSO PRESENT Thomas Callahan, Milford Police Chief; Jennifer Elowsky, Legal Counsel; Arthur Shufflebarger, Village Manager
 
APPROVE CONSENT AGENDA
 
CM-04-044-11 Heer moved, Glagola seconded, to approve the April 18, 2011, consent agenda as presented. Motion CARRIED.

CM-04-045-11 Heer moved, Glagola seconded, to approve the April 18, 2011, agenda as presented at the table. Motion CARRIED.
 
PRESENTATION
 
Police Department 2010 Annual Report Police
 
Chief Thomas Callahan presented an overview of the Police Department 2010 Annual Report (copy on file). He updated Council on the personnel changeovers, including two new supervisors, losing two employees and hiring two new employees. The staff still has one sergeant on Work Comp leave. Chief Callahan explained various ways the department has reduced costs, and updated Council on forfeiture cases. He stated any money captured through forfeiture can be used for training and equipment. They are currently working on grant money to purchase replacement vests and vests for the new officers. Chief Callahan stated there has been a decrease in tickets issued, due to a shortage of three officers. These are expected to increase. He added, as shown on the report, there has been an increase in larcenies and burglaries in Milford.
 
Mr. Shufflebarger complimented on the smooth transition that has taken place with Chief Callahan and the changes done in the Police Department.
 
NEW BUSINESS
 
Approve DPS Equipment Purchase, John Deere Mower
 
CM-04-046-11 Glagola moved, Heer seconded, to waive the normal bidding procedures as the State of Michigan has already bid the equipment and is offering the bid pricing to all communities. The State of Michigan discount is 23% off the standard price. Approve the purchase of one John Deere ZTRAK mower for the total of $9185.33. Funds are available in the DPS account number 101-441-982.
 
Council discussed the bidding process and under what circumstances bids could be waived or rejected. Since the bidding was solicited through the State and not the Village, it was felt the Village should have the opportunity to check pricing locally for a better deal.
 
Jennifer Elowsky stated the Village should not make a practice of soliciting for cheaper prices once competitive bidding has been accomplished. If Council wished to alter the process, they should establish a competitive bid policy and stick with this process.

Council wanted the option of using the State or Oakland County competitive bid price as a base and use this price to solicit locally for better pricing. This would only be done if the Village did not send out for bids. It would also be necessary to make sure the products where compared “apples to apples”.
 
CM-04-047-11 Aubry moved, Kovach seconded, to call the question. Motion CARRIED.
 
CM-04-048-11 Kovach moved, Aubry seconded, to waive the normal bidding procedures and purchase the John Deere ZTRAK mower from Weingartz for a price not to exceed $8,949.00; funds available in DPS account number 101-441-982.

Motion CARRIED.
 
Approve Sale of Used 1998 Dump Truck
 
CM-04-049-11 Glagola moved, Ziegler seconded, to approve the sell of the 1998 Dump Truck by using Ebay. Motion CARRIED.

MANAGER’S REPORT
 
Mr. Shufflebarger reminded Council of the Budget Session on April 20 which will be held at 6:30 p.m. He also advised Council of the Managers Evaluation that is done in July/August.
 
COUNCILMEMBERS REMARKS
 
Frankford informed everyone of the Relay for Life event, and upcoming fund raisers for this event.
 
Kovach distributed an information sheet showing comparison costs from other communities regarding refuse and hazardous waste collection
 
Aubry questioned a sign at Ruggle’s Café, and whether the Village had any increased liability by posting signs regarding surveillance in the park. Jennifer Elowsky stated there would not be increased liability.
 
Rusas encouraged all of Council to be at the Budget Session with the Police Department.
